The bill (Reg.No.11069) suggests amending article 7 of the Law of Ukraine "On the High Council of Justice" stipulating that people?s deputies of Ukraine, members of Cabinet of Ministers, heads of central bodies of executive power and heads of political parties cannot be members of the High Council of Justice.

 

The Committee members note that the status of the High Council of Justice is determined by the Constitution of Ukraine (article 131) and the Law "On the High Council of Justice" (article 3).

 

At the same time, suggested legislative amendments aim at prohibiting combining the duties of the Council member with participation in political activity or with representative mandate. It aims also at prohibiting hold any other office of profit or perform any paid work at executive positions of central bodies of executive power.

 

Thus, people?s deputies believe that the suggested changes should be thoroughly grounded, be of a unified character and stipulate amending special legislative acts that determine the status of central bodies of executive power, people?s deputies of Ukraine and political parties.

 

The Committee members believe that the abovementioned legislative suggestions are of fragmentary character and take into account neither the need of a unified approach to settle the issue under consideration, nor the special status of the High Council of Justice as a constitutional body responsible for reforming judiciary.
